ACCEPTANCE OF PLATER’S TERMS AND CONDITIONS (PLATER.COM.AU)

1. Terms of Service and Conditions: Governing the Use of Plater's Service

Plater (“Us”, We”, “Our”, “www.plater.com.au” , “The Service”), as the service provider, renders its services to the User (“You”, “Your”) in accordance with the following TOS/T&Cs (“Terms of Service” & “Terms and Conditions”, respectively). Plater reserves the right to amend, modify, or otherwise alter the TOS/T&Cs, in its sole and absolute discretion, without any prior notice or consent to the User. It is our intention to inform Users of any major changes to the TOS/T&Cs via our newsletter or email. 

 

2. Service Description: Plater's Two-Part Sale Service for Number Plates in Australia 

Plater.com.au is an online platform catering to the Australian market, offering a specialised classifieds listings service for the purchase and sale of number plates. Our website provides a seamless two-part sale service, facilitating Users with the means to Buy (“enquire to buy”) and Sell (“list to sell”) number plates across Australia. 

 

3. Accuracy: User Responsibility and Website Disclaimer 

Users of the Plater website acknowledge that the information, data, and listings displayed on the website may be subject to inaccuracies and delays. While we strive to maintain accurate and up-to-date information, the dynamic nature of the website, which enables users to interact beyond the purview of Plater's administration, renders our live website contingent on user-generated communication. As such, we make no warranty or representation as to the accuracy, completeness, reliability, or timeliness of the information contained on the website, and disclaim all liability arising from any reliance on such information. 

 

4. Account Security: User Responsibility 

As the registrant, you assume sole responsibility for generating and upholding the confidentiality of your account’s password. It is incumbent upon you to maintain the security of your account login details and to alert us immediately in the event of any unauthorised access or misuse. Users are expected to log out of their accounts at the end of each session, in order to mitigate any potential security breaches. Plater bears no responsibility for any damages or losses incurred due to your failure to adhere to the guidelines delineated in this section. 

 

5. User Responsibility and Content Terms for the Service Provided 

Users understand their responsibility to comply with the Content terms for the service provided by Plater as set out: 

(a) You, as the user of the plater.com.au website, acknowledge that all information, data, text, links, graphics, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. Thus, you are solely responsible for all Content that you upload, message, transmit or otherwise make available through the Service, and plater.com.au is not responsible for controlling the Content that is posted via the Service. Consequently, plater.com.au cannot guarantee the accuracy, integrity, or quality of such Content. 

(b) You understand that the Service may expose you to Content that is offensive, indecent, or objectionable, and under no circumstances will plater.com.au be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, messaged, transmitted or otherwise made available via the Service. 

(c) You agree not to use the Service to impersonate any person or entity, including but not limited to, a plater.com.au official, forum moderator, or to falsely state or otherwise misrepresent your affiliation with a person or entity, and not to collect or store personal data about other users. 

(d) You acknowledge that plater.com.au may or may not pre-screen Content, and that plater.com.au and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. 

(e) Without limiting the foregoing, Plater and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You must evaluate and bear all risks associated with the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Plater or submitted to plater.com.au, including without limitation information in plater.com.au Facebook Communities, Forums, Blogs, and all other parts of the Service. 

(f) You acknowledge that plater.com.au and its designees shall have the right to remove any member that violates the TOS or is otherwise objectionable. 

(g) You acknowledge, consent and agree that plater.com.au may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of plater.com.au, its users and the public. 

 

6. Terms of Use and Limitations of Liability 

6.1) The use of this site shall be limited to lawful purposes only. You are prohibited from posting or transmitting any material that infringes upon the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or objectionable in any other way. Furthermore, you shall not utilise the site to encourage criminal conduct, or to give rise to civil liability or otherwise violate any applicable law. Unless expressly permitted by plater.com.au, you shall not post or transmit any advertising material or solicitations related to products or services through the site. You are also prohibited from utilising the site to advertise or solicit any commercial activity, including, but not limited to, soliciting users to become subscribers of any online information services that compete with the site. Plater.com.au reserves the right to prohibit any conduct that restricts or inhibits any other user from using or enjoying the site. 

6.2) The site contains copyrighted material, trademarks, and other proprietary information, including, without limitation, text, software, photos, graphics, and all such content is protected under Australian copyright laws. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or exploit any of the content in any manner, in whole or in part. Unless otherwise permitted by copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material shall be permitted without the express written permission of plater.com.au and the copyright owner. If permitted, any such use shall not involve changes in or deletion of author attribution, trademark legend, or copyright notice, nor shall it transfer any ownership rights. 

 

7. Disclaimer of Liability and Warranty for the Use of the Site 

7.1) By accessing Plater, you agree that your use of the site is at your own risk. Plater.com.au, its affiliates, and their respective employees, agents, third party content providers or licensors do not guarantee that the site will be uninterrupted or error-free, and do not make any warranty regarding the results that may be obtained from the use of the site, or the accuracy or reliability of any information or service provided through the site. You acknowledge that any material you post or transmit through the site which violates or infringes the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, or encourages conduct that would constitute a criminal offence or civil liability, will not be tolerated. 

7.2) The site is provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, except for those warranties which are implied by and incapable of exclusion, restriction or modification under applicable law. 7.4) To the fullest extent permissible by law, in no event shall Plater’s total liability to you for all damages, losses, and causes of action, whether in contract, tort (including its own negligence), or under any other legal theory (including strict liability), exceed the amount paid by you, if any, for accessing this site. This does not affect any statutory rights which may not be disclaimed. 

 

8. Disclaimer of Responsibility for Advertiser Dealings and User Communications 

Your correspondence, business dealings, or participation in promotions with advertisers found on or through the Service are entirely at your own risk. Such dealings, including the payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the advertiser in question. You agree that plater.com.au shall not be held responsible or liable for any loss or damage of any sort incurred as a result of any such dealings, or as a result of the presence of such advertisers on the Service.

It is your responsibility to exercise due diligence and caution when dealing with such entities, and to take all necessary precautions to protect yourself from any harm or loss. 

By using the Service, you acknowledge and agree that plater.com.au is not responsible or liable for any content, advertising, products, or services provided by such third parties, nor does it endorse or guarantee the accuracy, completeness, reliability, or suitability of any such content, advertising, products, or services. You further acknowledge and agree that plater.com.au shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, advertising, products, or services available on or through any such third-party website or resource. 12. Accurate Information Policy 

As a prerequisite for accessing and utilising this website, you expressly agree and acknowledge that you shall not furnish any inaccurate, misleading, or deceptive information when filling out forms or fields intended to facilitate your inquiries, as well as the listing of number plates.

 

13. Restrictions on Automated Data Extraction and Use of Website Content 

In no circumstance shall automated scanning software be used to extract information from this website for any purpose, including but not limited to, feeding to another website, desktop gadget, or website plugin for commercial gain, freeware, archiving, or analysis. Furthermore, you may not use any automated processes to query, access or copy content presented on the websites operated by us without obtaining written approval in advance. Unless you have obtained prior written approval from plater.com.au, you may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell any information, images, software, products or services obtained from this website. Additionally, you may not use any portion of the material on the websites of plater.com.au to establish, promote, maintain or provide, or assist in establishing, promoting, maintaining, or providing your own publications, internet sites, desktop gadgets, applications, or other means of distribution without obtaining prior written approval from plater.com.au. The temporary copy held in the computer's cache is the only exception to the aforementioned restrictions. 

 

14. Listing Guidelines and Restrictions 

As a user of our website, you agree to comply with the following terms and conditions regarding the listing of number plates for sale: 

(a) Listings must be appropriate to the relevant category, and any listings that display items that are not appropriate to the category may be deleted without notice or refund. (b) It is the seller's responsibility to provide truthful and honest information about the product listed on the website. 

(c) If requested, the seller must correct or delete any misleading or incorrect information from the listing. Failure to do so may result in the removal of the ad without notice or refund. 

(d) Advertisements cannot be changed to promote a different product's details and photos unless permission has been granted by us. 

(e) Each advert is to list one set of plates; however, some exceptions may be made at our discretion.

(f) We reserve the right to edit ads that do not comply with a reasonable standard of presentation (e.g. spelling errors & layout) and/or contain misleading or deceptive information. 

(g) Classified listings are not to include references to listings on another site, and may be removed without refund or notification. 

(h) The Buy & Sell service is exclusively for trading number plates with display rights or collectable plates that are clearly marked as FOR DISPLAY ONLY. Business sellers must obtain written permission from us before listing items, and failure to do so may result in the removal of listings without refund and account suspension. 

(i) Listings and photos must not display any business name, web address, or email address unless by prior arrangement. 

(j) The Buy & Sell feature is only available for Australian listings, and international listings are not permitted. 

By using our website, you acknowledge and agree to abide by these terms and conditions. Failure to comply with these terms may result in the removal of listings, account suspension, or legal action. 

 

15. Payment and Transfer of Ownership Policies 

Transferring ownership of number plates is a straightforward process. Simply fill out a Transfer of Ownership form, exchange it for payment decided between you and the seller, and complete the process. It is important to remember that your plates remain the property of the state/country in which they are registered, and you are merely transferring the right to display your particular 

combination of characters. Fill out and sign the form, including your licence number, and exchange payment for the completed Transfer of Ownership form. Never hand over a completed Transfer of Ownership form without receiving full payment. 

 

16. Advertisement/Publications 

16.1) Premium Listings are automatically prioritised and exhibited to prospective buyers, yielding the highest amount of views and clicks. They require a one time payment and are

subject to movement contingent on the listing publication frequency (Peter please clarify the home page listing capacity. You can then establish the 45 day homepage hosting period). 

16.2) In the event that the Seller wishes to resurface their existing listing on the homepage, they will consider relisiting at full cost in order to resurface their number plate. 

16.3) Pursuant to the terms and conditions governing the Service provided by Plater, the purchase of listings via the Want to Buy ("WTB") category does not assure the seller that enquiries which are genuine or aligned with the seller's preferences will be received or facilitated by Plater or its service. The WTB category is an elective feature that provides prospective buyers with the prospect of establishing contact with other users or members of the number plate community who possess plates with similar patterns. It is emphasised that Plater and its service do not guarantee or warrant the accuracy, authenticity or appropriateness of the enquiries facilitated via the WTB category. The use of the WTB category is thus at the sole discretion and risk of the user.
